The tragic accident occurred on February 3, 2015, when a Metro-North train collided with a Mercedes SUV at the Commerce Street crossing in Valhalla, NY. The impact resulted in the train pushing the car forward, which, in turn, dislodged an elevated third rail, causing it to penetrate the train. The accident caused a catastrophic fire and claimed the lives of five passengers and the driver of the SUV.
“This case reminds us of the need for improved safety in our public transport systems. It was a completely preventable tragedy and a great loss to the families of the victims and loved ones,” said Eric Richman.
The Jury found that Metro-North was negligent in two critical areas: the train engineer’s failure to slow down when he saw the SUV’s reflection near the tracks and the flawed design of the rail system, which failed to break away upon impact. They assigned 71% of the blame to the MTA for its flawed third-rail design and operational negligence. The remaining 29% was attributed to Ellen Brody, the SUV driver.
